These Terms of Service ("Terms") govern your use of the construction document management services and website provided by boldfrontier d.o.o. ("we", "our", or "us"). By accessing or using our services, you agree to be bound by these Terms.

By accessing, browsing, or using our website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our services.

User Obligations

When using our services, you agree to:

• Provide accurate, current, and complete information when creating accounts or using our services

Intellectual Property

The boldfrontier services, including all software, documentation, designs, graphics, and other materials, are protected by intellectual property laws and are the exclusive property of boldfrontier or our licensors.

You are granted a limited, non-exclusive, non-transferable licence to use our services solely for your internal business purposes. You may not:

• Copy, modify, distribute, sell, or lease any part of our services
• Reverse engineer or attempt to extract the source code of our software
• Remove or alter any proprietary notices or labels
• Use our trademarks, logos, or brand names without written permission

Data and Privacy

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms part of these Terms. By using our services, you consent to the processing of your data as described in our Privacy Policy.

Service Availability and Maintenance

While we strive to maintain high service availability, we do not guarantee uninterrupted access to our services. We may perform scheduled maintenance, updates, or emergency repairs that may temporarily affect service availability.

We will make reasonable efforts to notify users of planned maintenance in advance. We are not liable for any downtime, data loss, or other issues arising from necessary maintenance activities.

Limitation of Liability

To the maximum extent permitted by applicable law, boldfrontier shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use our services
• Any unauthorised access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from our services
• Any bugs, viruses, trojan horses, or the like that may be transmitted by any third party
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content

Our total liability to you for all damages, losses, and causes of action shall not exceed the amount paid by you to boldfrontier in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless boldfrontier, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of our services
• Your violation of these Terms
• Your violation of any rights of any third party
• Your Customer Data or any content you submit through our services

Termination

Either party may terminate the service agreement at any time with appropriate notice as specified in your service contract. We may also terminate or suspend your access immediately, without prior notice, if you breach these Terms or engage in conduct that we determine to be harmful to our business, other users, or third parties.

Upon termination:

• Your right to use our services will cease immediately
• We may delete your account and Customer Data after a reasonable notice period
• You remain liable for all charges incurred prior to termination
• Provisions that by their nature should survive termination will continue to apply

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Slovenia, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Slovenia.

If you are a consumer residing in the European Union, you may have additional rights under local law, and nothing in these Terms affects those rights.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the modified Terms.

If you do not agree to the modified Terms, you must stop using our services and may terminate your account.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the intent of the original provision.
